Judge rules Musk's role in shutting USAID likely violated the Constitution's appointments clause
What he said or did
US District Judge Theodore Chuang in Maryland found that Musk had firm control over DOGE
and that Musk has exerted actual authority at USAID that only a properly appointed Officer can exercise,
barring further DOGE steps to dismantle the agency. He cited Musk's post that he had fed USAID into the wood chipper
(PBS; TechCrunch).
Background
USAID's staff were placed on leave and its operations largely halted in early February 2025. The government described Musk as a special advisor to the president
rather than DOGE's head (TechCrunch).
Official response
The White House and DOGE did not immediately respond (PBS).
Fact-checks and findings
Chuang wrote: Taken together, these facts support the conclusion that USAID has been effectively eliminated
(PBS).
What happened next
On 28 March 2025 a Fourth Circuit panel lifted the order; Judge Marvin Quattlebaum wrote that unconventional does not necessarily equal unconstitutional
and that Musk's posts did not legally prove he made the orders (AP).
