SpaceX sues National Labor Relations Board a day after complaint over fired employees
What he said or did
A day after NLRB prosecutors accused SpaceX of unlawfully firing eight employees over an internal open letter criticising Musk, SpaceX sued the board in federal court, arguing its structure is unconstitutional because members and judges are shielded by removal protections.
Background
The open letter, circulated by employees in 2022, said Musk's public behaviour embarrassed the company and called on SpaceX to distance itself from his personal brand (The Register).
Official response
The NLRB declined to comment (The Register).
What happened next
On 19 August 2025 the US Court of Appeals for the Fifth Circuit allowed SpaceX and two other companies to keep court orders freezing NLRB unfair-labour-practice cases while their constitutional challenges proceed; Judge Don Willett wrote that employers should not have to choose between compliance and constitutionality
