Background

The FAA alleged SpaceX used an unapproved launch control room and an unapproved rocket propellant farm during two 2023 launches. SpaceX was also disputing delays to its Starship launch licence.

Official response

FAA Chief Counsel Marc Nichols said Failure of a company to comply with the safety requirements will result in consequences (Axios). Whitaker told a House subcommittee that fines are the agency's only compliance tool and that the Starship delay was a safety matter (Space.com).

What happened next

Fortune reported that Musk gave no further details of the threatened lawsuit.
