Musk adds antitrust claims against OpenAI and Microsoft, seeks to stop investors being asked to avoid xAI
…group boycott.
What he said or did
Musk's lawyers expanded his federal suit to allege that OpenAI and Microsoft violated antitrust law, including by asking investors not to fund rivals such as Musk's xAI, which they called a group boycott.
A motion filed 29 November sought a preliminary injunction against the practice and against OpenAI's for-profit conversion.
Background
Musk, an OpenAI co-founder who later founded competitor xAI, first sued OpenAI in 2024 alleging it abandoned its nonprofit mission.
Official response
OpenAI said: Elon's fourth attempt, which again recycles the same baseless complaints, continues to be utterly without merit.
Microsoft declined to comment.
Fact-checks and findings
Judge Gonzalez Rogers said there was a substantial amount of evidence to support the jury's finding.
What happened next
On 4 March 2025 Judge Yvonne Gonzalez Rogers denied the preliminary injunction, and the antitrust claims were later stayed while other claims went to trial. On 18 May 2026 a jury found that Musk's breach of charitable trust and unjust enrichment claims were filed too late, and the judge dismissed them. Musk called the verdict a terrible precedent
and said he would appeal. The reports reviewed do not state the current status of the stayed antitrust claims.
