Musk says European Commission offered X an 'illegal secret deal' after preliminary DSA breach findings
…an illegal secret deal
What he said or did
After the Commission issued preliminary findings that X breached the Digital Services Act, Musk wrote that it had offered X an illegal secret deal
to quietly censor speech in exchange for no fine, and said X looked forward to a very public battle in court.
Background
The Commission's preliminary findings said X's paid blue checkmark misled users, its ad repository was inadequate and it blocked researcher data access. DSA breaches can carry fines of up to 6% of global turnover.
Official response
Commissioner Thierry Breton wrote on X: There has never been — and will never be — any secret deal. With anyone,
adding that the DSA lets platforms offer commitments to settle a case.
What happened next
The Commission fined X €120 million on 5 December 2025 over the same transparency breaches (see separate entry).
